Research Memo:
Definition
Same-sex marriage, also called gay marriage or homosexual marriage, is the marriage between two people of the same sex.
Where it began
Unions between two same-sex people have existed for more than a thousand years. Richard John “Jack” Baker and James Michael McConnell [1] was the first known same-sex couple applied for a marriage license in the U.S. They applied in Hennepin County, Minnesota in May 1970. They appealed to the Minnesota Supreme Court after being turned down; Supreme Court dismissed the claim “for want of a substantial federal question. They reapplied in another Minnesota county again and obtained a marriage license from there and became the first same-sex couple to get married.
DOMA and Prop.8
There are two major setbacks to the gay marriage movement. The first one is the U.S Congress passed DOMA in 1996 when President Clinton signed it into law. [2] DOMA forbids the federal government recognizing same-sex couples from the institution of marriage. It also gives states power to refuse to recognized any same-sex marriage that is granted under other states’ laws.
The second setback is California Proposition 8, also known as Prop 8- Eliminates Right of Same-Sex Couples to Marry. California voters approve Prop 8, a gay marriage ban, on November 4, 2008. It also added a provision to California Constitution which said only marriage between a man and a woman is valid and recognized by the state of California
Love wins
On June 26, 2015, after Supreme Court declaring the right to same-sex marriage, The United States becomes the 21st country in the world legalized gay marriage. [3] Former President Obama said that gay marriage ruling is a “big step” towards equality after The Supreme Court ruled same-sex couples have rights to get married under the U.S. Constitution.
Conclusion
The same-sex marriage fight is still far away from over. Activists continue fighting for equal right, while others are fighting against them, against gay marriage. There are nearly 200 countries in the world; gay marriage is only legally recognized in 22 of them. There’s still a long way to go.
