I. Presenting Problem:

Referral Source: Mandated Reporter. Written cross-report from SJPD. # 17-225-0538.

Family Composition/Composition of the Home: This is a non-intact, Caucasian/Hispanic, English-speaking family. The mother is identified as Shannon Nolen and the father is identified as Joel Plazola. The parents have two children in common: Dante (age 7) and Luciano (age 3 months).

Referring Party Details of Concern: It was reported that the parents were involved in an escalated argument and that the father physically harmed the mother, which resulted in the father’s arrest. There are concerns for the children’s exposure to domestic violence in the parents’ relationship and the mother’s ability and willingness to protect her children, which places their health and safety at risk.

On 8/13/17, law enforcement responded to a domestic violence call that occurred in the parking lot behind the Alum Rock Library in San Jose. It was reported that the parents were in an escalated argument and that the father shoved the mother, which resulted in the mother hitting her head, as well as sustaining a laceration above her right eye. The father was searched and a glass pipe commonly used for smoking methamphetamine was reportedly found on him. The father was arrested for domestic violence and drug paraphernalia.

Complicating Factors: On 8/13/17, the mother reported that she found the father with another female and sustained her injury due to the unidentified female punching her in the face, which the father denied the alleged incident took place. There is a prior domestic violence incident that was reported in 2016; case # 16-235-0954. The mother is reportedly listed as a protective party in a peaceful contact criminal restraining order against the father.

Decision and Rationale: Refer to ER as a 10-day follow up to further assess the risk/safety of the children and their exposure to domestic violence between the parents as the father was arrested for physically harming the mother; due to reported past history of domestic violence between the parents; due to the young ages of the children (ages 3 months and 7), which places their health and safety at high risk; and to further assess the mother’s ability and willingness to protect the children.

1. 08/09/2016: An allegation of general neglect of the child, Dante Nolen, against the mother, Shannon Nolen, was determined to be inconclusive. It was reported that the child was being hit with a wooden stick by the Maternal Grandmother and Great Grandmother, and the mother was failing to protect the child. The mother reported no knowledge of this, and the MGM and MGGM reported that they were unaware that it was against the law until recently, and has since stopped using it to discipline the child.
2. 05/01/2017: An allegation of general neglect of the child, Luciano Plazola, and at risk/sibling abused of the child, Dante Nolen, against the mother, Shannon Nolen, were determined to be inconclusive. It was reported that the child was born with health problems, and the mother had tested positive during prenatal care appointments for methamphetamine. It was also reported that the mother was unwilling to engage in drug treatment services or a Public Health Nurse. The mother and child tested negative for all substances at the time of birth. The mother did engage in PHN services as well as the BRIDGE program. The mother tested negative at the time of intervention.

III. Findings:

Completed face to face interview with the mother, Ms. Shannon Nolen, DOB: 03/08/1982:

On 08/22/17, the assigned Social Worker completed a face to face interview separately with the mother, Ms. Shannon Nolen, DOB: 03/08/1982 at the given address of the referral.
This worker was invited to the home by the mother, Ms. Nolen and the maternal great grandmother, Ms. Karin McLaughlin.
The mother, Ms. Shannon Nolen, the children, Luciano, Plazola, DOB: 04/30/2017, and Dante Nolen DOB: 07/12/2010, the grandmother, Ms. Mary McLaughlin, D.O.B: 08/06/1960, the great grandmother, Ms. Karin McLaughlin, DOB: 07/22/1938, and the great grandfather, Jim McLaughlin, DOB: 05/24/34, reside at the given address of the referral.
This worker discussed with the mother the allegations, the CPS process, and provided her business card.
This worker observed the children, Luciano, Plazola, and Dante Nolen, physically healthy, nurtured, and well kept.

Ms. Nolen reported that on 08/13/17, she and the father had a verbal argument in the parking lot behind the Alum Rock Library in San Jose, as a result of the escalation of the argument; the police were called and the father was arrested.Further, the mother denied any physical abuse by the father, Mr. Joel Plazola although she added that the father experiencing mood swings that may cause verbal arguments. Furthermore, Ms. Nolen added that on 08/13/17, she saw her boyfriend with a Hispanic female after she had been looking for him since last night (08/12/17). Ms. Nolen reported that she was able to locate her boyfriend at a park near White Road in San Jose where she confronted him about the female and as a result the female punched her one time in the face causing the laceration above her right eye. Ms. Nolen also added that on 08/13/17, the police could not locate the Hispanic female, the father was arrested, and that she refused medical attention. Ms. Nolen admitted that she had the baby Luciano with her during this incedent but her son, Dante was not with her at that time.
Further, the mother reported that the father was born with hypertonicity muscles and was diagnosed with “hypertonia” which may cause lacking flexibility and poor balance although, she reported that the father was working for his father’s construction company as a constructor.

Ms. Nolen reported that the father has Native American Roots but she does not know the name of the tribe.

Ms. Nolen reported that she is not taking any medications, she does not have any mental health issues, or was sexually abused in the past. This worker observed a minor laceration above the mother’s right eye and the mother denied that the father caused this laceration.
Ms. Nolen denied that she and everyone in the home, use drugs, have mental health issues, or use alcohol nevertheless, she admitted that she occasionally drinks.

The mother, Ms. Nolen ranked herself at “10” where zero is the least safe and depressed and “10” is the safest and most depressed. Additionally Ms.Nolen denied having any thoughts of, or plan for, self-harm.

This worker asked the mother to take off Luciano’s clothes to check for marks or bruises. This worker observed no marks or bruises on Luciano’s body.
The baby, Luciano, appeared to be physically healthy, nurtured, and well kept.
Ms. Nolen reported that Luciano’s immunizations are currently up to date. Further, Ms. Nolen reported that she was taking drugs while she was pregnant with her son Dante but she has been sober since she gave birth to her son Dante. Further, the mother added that she agrees to conduct a drug test at any time.

@@@@@When asked whether the mother to file a restraining order aginst the father, Mr. Plazola, Ms. Nolen responded that she did not file a restraining order. This worker discussed with the mother, the risk of exposing children to domestic violence. Additionally, this worker discussed the safety plane with Ms. Nolen. Ms. Nolen reported that she will file a Restraining Order against the father, Ms. Plazola if he shows up at the home. In addition, she will keep all doors locked at all the time.

The mother and the children have medical, food stamps ($300), and cash aid, ($300). The mother reported that she pays for her own meals.
The mother denied the need for any services other than that what she is currently getting from the department. Additionally, she stated that she is currently trying to registor as an Uber driver after she obtained the background clearance. The mother has no probations or warrants.

The mother has no questions to ask this worker.

Face to face interview with the maternal grandmother, Ms. Mary McLaughlin, DOB: 08/06/1960:

On 08/22/17, the assigned Social Worker completed a face to face interview separately with the maternal grandmother, Ms. Mary McLaughlin at the given address of the referral.
This worker discussed the CPS process and provided the maternal grandmother with her business card.

The maternal grandmother reported that her daughter. Ms. Nolen did not tell her the details of what has happened on the day of the incident at the library on 08/13/17. Further, the maternal grandmother stated that she found out about the incident a few days after the father was arrested on 08/13/17.
The maternal grandmother reported that Ms. Nolen is taking good care of the children, Louciano and Dante, additionally she reported that the mother never missed their doctor’s appointments and that their immunizations are up date.

The maternal grandmother reported that she and all of the family members have been and will contuinue to provide support to the mother, Ms. Nolen and her children, Luciano and Dante.This worker discussed with the maternal grandmother the risk of exposing children to domestic violence. Additionally, this worker informed the maternal grandmother that it is very important for this family to creat a safety paln if the father shows up at home or at Dante’s school.
The maternal grandmother has no questions to ask this worker.

Completed face to face interview with the maternal great grandmother, Ms. Karin McLaughlin, DOB: 07/22/1938:
On 08/22/17, the assigned Social Worker completed a face to face interview separately with the maternal great grandmother, Ms. Karin McLaughlin at the given address of the referral.
This worker had to set close by Ms. Mclaughlin because she has difficulty hearing the questions asked by this worker.
Ms. Mclaughlin reported that she is a retired registered nurse and she is currently picking up and droping Dante from and to school. Further, Ms. McLaughlin added that she loves her grandchildren and she will continue to provide support and help the mother, Ms. Nolen and her children Luciano and Dante.

This worker discussed the CPS process and provided the great grandmother with her business card.
The maternal great grandmother reported that she does not interfere with anyone’s business in the home and that hse minds her own business. Additionally, she added that she will offer help if needed.
The maternal grandmother has no questions to ask this worker.

Attempted face to face interview with the great grandfather, Mr. Jim McLaughlin, DOB: 05/24/34:
The great grandfather refused to be interviewed, stated that he has nothing to report, and does not want to be involved in this investigation. Nonetheless, this worker provided her business card to the great grandfather, Mr. McLaughlin.

Face to face interview with the child, Dante Nolen, DOB: 07/12/2010:

On 08/22/ 17, this worker completed a face to face interview separately with the child, Dante at the given address of the referral.
This worker observed the child, Dante Nolen, physically and mentally healthy, happy, and well kept,

In order to explain the difference between telling the truth and telling a lie, this worker asked fact questioners. The child, Dante appeared to be cognitively on target and ready for the interview questions.
The child, Dante reported that he attends “Toyan Elementary School” in San Jose. Further Dante described himself as a happy, a smart, and a good student who has very good grads at school furthermore, he reported that he likes his school, friends, and teachers with the exceptions of some friends that he described them as “mean friends”. This worker asked Dante why he described his friends as “mean”. Dante replied that sometimes his friends refuse to play with him and that is the reason why he described them as mean.

The child, Dante ranked himself at “10” where zero is the least happy and safe and “10” is the happiest and the safest. Furthermore, Dante added that when he needs help orwhen he is in trouble, he goes to his mother, grandmother, great-grandmother, or teachers.

The child, Dante stated that his parents do not fight but he tells them to stop being loud when they’re arguing.
Further, Dante, reported that he was never been hit by his parents or his grandparents and that they verbally dicplin him at all times.

IV. Family Strengths:

Family members have expressed concern for the mother, Ms. Nolen Shannon, the children, Luciano and Dante, and willing to creat a safety to keep the mother and the children safe. This family has a stable housing.
The child, Dante can articulate he knows his family loves him and his basic needs are met. The mother has an active restraining order against the father.

V. Risk to the Children:
